Terms of service.

The agreement between you and The Obelisk App Inc.

Effective: November 6, 2026

These terms are an agreement between you and The Obelisk App Inc., a Delaware corporation ("Obelisk", "we", "us"), for using Obelisk at theobelisk.app and app.theobelisk.app (the "service"). By creating an account, starting an audit or otherwise using the service, you agree to them. If you use Obelisk for a company, you confirm you can bind it, and "you" means that company.

These documents are part of the terms:

Our privacy policy and cookie policy explain how we handle personal data as a controller.

1. Who can use Obelisk

Obelisk is a business tool. You must be at least 18 and able to form a binding contract, and you must use Obelisk for your business or profession, not as a consumer. You may not use Obelisk if you're barred from receiving services under US law or other laws that apply to you, including sanctions.

2. Accounts and workspaces

  • Give accurate details and keep your sign-in secure. You're responsible for everything done under your account, including by the people you invite and by agents you run.
  • Your organisation has owners, admins and members. Owners and admins control who joins, what they can do, which tools are connected and how agents behave. They can remove members and their access at any time.
  • Tell us right away at support@theobelisk.app if you think someone got into your account.
  • For help, email support@theobelisk.app or use the contact form in Obelisk. Service status is on our public status page.
  • Each seat is for one named person. Don't share sign-ins.

3. Plans, trials and billing

Plans. Obelisk has a Free plan and paid plans (Pro, Team and Agency). Each plan has limits, such as sites, pages checked per audit and per month, audit frequency, competitors, seats and a monthly AI budget. The pricing page shows current prices and limits. Hybrid and Enterprise plans are agreed in an order form.

Trial. Each organisation can try the Team plan free for 14 days, once, without a card. We show the trial's end date before it starts and email you before it ends. If you've added a payment method by then, your paid subscription starts when the trial ends. If you haven't, your account moves to the Free plan and nothing is charged.

Automatic renewal. Paid plans renew automatically at the end of each billing period, monthly or yearly as you choose, at the price then in effect for you, until you cancel. We email you before each charge. By subscribing, you authorise us and Stripe, our payment processor, to charge your payment method for each renewal and for any seats or changes you add.

Seats and changes. Team and Agency include a number of seats, and you can add more at any time. Upgrades and added seats are charged pro rata for the rest of the current period. Downgrades, fewer seats and switches from yearly to monthly take effect at the end of the current period.

Taxes. Prices are in US dollars and exclude taxes. We add sales tax, VAT or similar taxes where the law requires, based on the billing details you give us. You can add a tax ID in your billing settings.

Failed payments. If a payment fails, Stripe retries it and we tell you. Until it succeeds, your account has the Free plan's features. Your data stays in place.

Price changes. We'll email you at least 30 days before a price change affects you. Your current price stays the same on renewals for 12 months after we publish the new price, then the new price applies from your next renewal. If you change your plan or billing period yourself, the price current at that time applies.

Cancelling. Cancel at any time in two clicks from your billing settings. You keep your paid features until the end of the period you've paid for, and you won't be charged again. Your account then moves to the Free plan.

Refunds. Payments aren't refundable, including for partly used periods, except where the law requires a refund, where these terms say so, or where we choose to give one. If you think a charge is wrong, email support@theobelisk.app before disputing it with your bank, and we'll sort it out.

4. Usage limits and fair use

When you reach a plan limit, Obelisk tells you which limit and what you can still do. Monthly limits reset at the start of each calendar month (UTC). To keep the service fast and costs predictable for everyone, Obelisk also applies spending caps to AI and third-party data, and rate limits on audits, sign-ups and messages. We may slow or pause use that puts the service or other customers at risk, and we'll tell you why.

5. Acceptable use

You must follow the acceptable use policy. In short: audit only sites you're allowed to audit, send messages only to people who agreed to hear from you, connect only accounts you're authorised to use, don't try to trick Obelisk's AI into misbehaving, and don't abuse Obelisk, other websites or other people. We may suspend use that breaks it, as section 14 describes.

6. Your content

It stays yours. "Your content" means everything you or your team put into Obelisk or connect to it: your sites, audit settings, documents, chat messages, brain facts, tracking data, leads, and data from connected tools. As between us, you own your content and the outputs Obelisk produces for you from it.

Our licence to it. You give us a worldwide, non-exclusive licence to host, copy, process, transmit and display your content only to provide, secure and support the service for you, as our privacy policy and data processing addendum describe. We don't use your content to train AI models, and we don't sell it.

Aggregate statistics. We may create de-identified, aggregated statistics from how Obelisk is used and from audit results, such as average scores by site type, to build benchmarks and improve our checks. They never identify you, your sites or any person.

Your responsibility. You confirm that you have the rights and permissions your content needs, including telling visitors about Obelisk tracking and getting consent where the law requires it. Don't upload anything the acceptable use policy forbids. You're responsible for backing up anything you can't afford to lose.

7. Connected tools and agent actions

Connecting. You can connect Obelisk to services such as Google Search Console, Google Analytics, WordPress, GitHub, Slack, Linear and Jira. When you connect one, you authorise us to access it with the permissions you grant, for the features you use. You can disconnect at any time in Obelisk or in the other service.

Agents act only as you allow. Obelisk's agents change your connected tools, such as publishing a post, opening a pull request, posting a message, filing an issue or sending an email, only:

  • when a person in your workspace with the right permission approves that action; or
  • within the autopilot settings an owner or admin turned on, which list the actions an agent may take on its own, a monthly cap on actions and a monthly budget.

Autopilot is off until you turn it on. You can pause every agent in a workspace at once. Requests for approval expire after 7 days.

Before and after. Each action shows what it will change before you approve it, and records what it changed. Where the connected service allows, you can undo it: Obelisk restores what was there unless someone has changed it since. Approved email waits 2 minutes so you can cancel it; after that it's sent. Some actions can't be undone in the other service, such as an email or message someone has already read.

Your responsibility. Actions you approve, and actions an agent takes within autopilot settings you chose, are your instructions to us, and you're responsible for them and for complying with the other service's terms. We're responsible for carrying them out as approved or configured.

Other services' terms. Connected services are run by other companies under their own terms and privacy policies. We aren't responsible for their availability, how they handle your data, or changes they make that affect how Obelisk works with them.

8. AI features and their output

Obelisk uses AI to read pages, judge some checks, write summaries, reports and drafts, answer questions and run agents. AI can be wrong, incomplete or out of date, even when it sounds sure. So:

  • Check AI output before you rely on it, publish it or send it, especially anything legal, financial, medical or about real people.
  • Obelisk shows its sources where it can. Use them.
  • AI output isn't professional advice.
  • Other customers may get similar output for similar requests. Your outputs are yours, but we can't promise no one else has something like them.

9. Third-party data

  • Google. Search Console and Google Analytics data come from Google when you connect them, and Google's terms govern your use of its services. Real-visitor speed data comes from Google's Chrome UX Report where Google has enough data for a site.
  • DataForSEO. Keyword, ranking, backlink, competitor and AI-mention figures come from DataForSEO. They are estimates, labelled with their source and date. Treat them as directional, not exact.
  • You may use third-party data in Obelisk only for your own marketing and your clients', not to resell or build a dataset.

We aren't responsible for errors or outages in data from these providers.

10. Obelisk tracking

If you use the Obelisk tracking script, you're the controller of the data it collects and we're your processor under the data processing addendum. You must describe it in your privacy policy (you can use our wording), show a cookie banner where the law requires one, and follow the tracking rules in the acceptable use policy.

12. Our service and intellectual property

Obelisk stays ours. The software, design, check library, scoring, prompts, agents, documentation and brand belong to us and our licensors. Subject to these terms, we give you a limited, non-exclusive, non-transferable right to use Obelisk for your business during your subscription. These terms don't give you any other rights in Obelisk.

Feedback. If you send us ideas or suggestions, we may use them freely, without owing you anything.

Previews. We may offer some features as previews, which we label in Obelisk. They may change or be removed, and section 16's disclaimers apply to them in full.

Changes to the service. We improve Obelisk constantly and may add, change or remove features. If we remove a paid feature that's a main reason you subscribed, we'll tell you in advance and you may cancel and receive a pro-rated refund for the unused part of your current period.

Availability. We work to keep Obelisk available and fast, but we don't promise it will always be available or error-free, and we offer no uptime commitment unless an order form says so.

13. Confidentiality

Each of us will keep the other's non-public information confidential, use it only for this agreement, and share it only with people who need it and are bound to keep it confidential. This doesn't cover information that is public, that the receiver already had or developed independently, or that it must disclose by law (after notifying the other where the law allows).

14. Suspension and ending the agreement

You can stop using Obelisk at any time, cancel your plan and delete your account in Obelisk. Account deletion has a 7-day grace period in which you can change your mind; after that it's permanent.

We may suspend your access, an agent, a site or a connection, or end this agreement, if you seriously or repeatedly break these terms or the acceptable use policy, don't pay, put Obelisk, other customers, other websites or other people at risk, or if the law requires it. Where we reasonably can, we'll give you notice and a chance to fix the problem first.

Afterwards. Your right to use Obelisk ends. Before your account is deleted, you can export your audits and ask us for a copy of your data at privacy@theobelisk.app. We then delete your data as our privacy policy describes. Sections 3 (for amounts owed), 6, 12, 13 and 15 to 20 continue to apply.

15. Your promise to cover us

You will defend and indemnify Obelisk and its officers, employees and contractors against third-party claims, and the losses, damages, fines and reasonable legal costs that result, arising from: your content; sites, accounts or systems you audit or connect without the right to; actions you approve or that agents take within autopilot settings you chose; messages you send through Obelisk; your use of Obelisk tracking; or your breach of these terms, the acceptable use policy or the law. We'll tell you promptly about the claim, let you control its defence (you may not settle a claim that admits fault for us or binds us without our consent), and give reasonable help at your cost.

16. Disclaimers

Obelisk gives information, recommendations and automation for marketing. It doesn't guarantee search rankings, traffic, AI search visibility, leads, revenue or other business results. Search engines and AI tools change how they work without notice.

Except as these terms expressly state, Obelisk is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free operation.

17. Limits on liability

To the fullest extent the law allows:

  • Neither of us is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business, data or goodwill, even if told they were possible.
  • Each party's total liability for all claims arising from or relating to these terms or Obelisk is limited to the greater of the amounts you paid us in the 12 months before the event giving rise to the claim, and US$100.

These limits don't apply to your payment obligations, your obligations under section 15, either party's breach of section 13, or liability that the law doesn't allow to be limited, such as for fraud, gross negligence or wilful misconduct, or for death or personal injury caused by negligence.

18. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods doesn't apply. Before going to court, the party with a dispute must email the other a description of it (to us at legal@theobelisk.app) and both must try in good faith to resolve it for 30 days. After that, the state and federal courts located in Delaware have exclusive jurisdiction, and both of us consent to them. Either party may seek urgent relief to protect its intellectual property or confidential information in any competent court.

19. Changes to these terms

We may update these terms. If a change matters, we'll email account owners and show a notice in Obelisk at least 14 days before it takes effect, unless a change is needed sooner for legal or security reasons. If you keep using Obelisk after it takes effect, the new terms apply. If you don't agree, cancel before then; if you paid for a yearly plan, you may instead ask for a pro-rated refund for the unused months.

20. General

  • Whole agreement. These terms, with the documents listed at the top, are the whole agreement between us about Obelisk and replace earlier agreements on the subject. If documents conflict, this order applies: an order form, the data processing addendum (for personal data), these terms, then the policies.
  • Notices. We send notices to the email address of your account's owners. Send legal notices to legal@theobelisk.app. You agree that electronic notices and records satisfy any requirement for writing.
  • Assignment. You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets, and we'll tell you.
  • Force majeure. Neither of us is liable for delays or failures caused by events beyond reasonable control, such as outages of internet or cloud providers, natural disasters, war or government action. This doesn't excuse payment.
  • Independence. We're independent contractors. These terms create no partnership, agency or employment relationship and give no rights to third parties.
  • Severability and waiver. If part of these terms can't be enforced, the rest still applies and that part is enforced as far as possible. Not enforcing a right straight away doesn't waive it.
  • Export laws. You won't use or export Obelisk in breach of US or other applicable export control or sanctions laws.
